MSc Canada Refugee Claims
 


Each year, millions of people around the world are forced to flee their homelands to escape persecution, war or severe human rights abuses. Often these people are never able to return home. Canadian government, keeping in touch with its humanitarian tradition offers protection to thousands of such people every year.

Based on its international obligation, Canada has a refugee system that allows individuals to sponsor refugees from abroad who can qualify to come to Canada for a respectful living. Canada’s refugee protection system consists of two main components:

  1. The Refugee and Humanitarian Resettlement Program, for people seeking protection from outside Canada; and
  2. The In-Canada Refugee Protection Process, for persons making refugee protection claims from within Canada.

Refugees may be sponsored by the federal government or by private groups or have their own financial resource, though they are separated into different groups under the refugee class. These are the Convention Refugees Abroad and members of the Country of Asylum and Source Country Classes. A person is deemed as a Refugee or a Person in Need of Protection under the following categories:

Refugees selected Abroad
In-Canada Refugee Program
Pre-Removal Risk Assessment (PRRA)

Reasons for claiming refugee protection

A Convention refugee means that the claimant has a well-founded fear of persecution. There are five grounds of persecution, recognized by the international community: race, religion, nationality, membership in a particular social group and political opinion. When someone claims refugee status, there must be a relation between the fear of persecution and one of the five grounds as enumerated above.

When claiming refugee status, one can identify the grounds or not. It will be up to the Refugee Division of the IRB (Immigration and Refugee Board) to determine whether the grounds referred to is genuine or not or whether there are other grounds of persecution.

Process of Claiming Refugee Status
The process of claiming refugee status in Canada begins by making a refugee claim either upon entry into Canada or at a later date after already entering Canada. Claimants will be provided with an opportunity to attend a hearing at the Refugee Protection Division of the Immigration and Refugee Board where they will personally present their case to a Board Member who will decide whether or not to grant them refugee protection.

In Canada, the refugee claimants are allowed to work and earn their own living until their case is heard by the Refugee Protection Division. If their case is approved, they are allowed to apply for permanent resident status, including all the members of their family.

In addition the applicants must be able to re-establish their lives in Canada and pass medical examinations and security assessment. A successful refugee claimant can apply for permanent residence in Canada.
